The client is
deemed to agree and accept these terms & conditions of business of virtue of an
interview or the engagement of an applicant by the client or use of the applicant by the
client as a direct permenant worker. The client shall deem interviewing of a Jam I.T.
Consultancy Ltd candidate an acceptance of these terms & conditions. 2. The fee payable by the client to the company is for the introduction of an applicant. The word ‘introduction ‘ means, for the avoidance of doubt, the presentation written or oral of the applicant by the company to the client for engagement, whether or not the client knew of such applicants previously. The fee is payable immediately if the applicant is employed by the client. 3. The introduction fee payable by the client for the introduction of an applicant resulting in an engagement is in accordance with the scale detailed below. Salary is deemed to include the annual basic salary or wage or retainer paid, plus any allowance (including meal allowance, shift allowance) or other payments forming a part of taxable emoluments. In the event that any salary is guaranteed for a period of less than 12 months of the annual salary will be calculated as if such payment were guaranteed for the entire 12 months period, pro rata. 4. Standard fees calculated by Jam Recruitments.
The above standard rates may vary dependant on volume and regularity of business, and in respect of psa (preferred supplier agreement). 5. Written confirmation must be obtained from a director of the company in order to vary any of our terms & conditions of business. 6. The company will endeavour to ensure the suitability of applicants introduced to the client. The company does not personally establish references, unless requested by the client. The client shall be responsible to establish refference’s concerning the applicants skill’s and qualifications and general integrity. The client shall be responsible for ensuring such qualifications as are required by law and the company does not arrant the applicant suitability and/or qualification. 7. The company can accept no liability of any kind for loss or damage to property or for any other loss including without prejudice to the generality of the foregoing loss of profits or for any injury to persons arising directly or indirectly from any omission of any applicant introduced to the company even if such act or omission is negligent or fruadulent or dishonest. 8. The appropriate introduction fee is payable by the client immediatley upon receipt of invoice.9. It is important to note that the company does not recognise any trial periods. However, should employment terminate lawfully within 12 weeks of commencement, the following rebate period applies: 75% on 1st month, 50% on second month and 25% during 3rd month. 10. Please note the client shall not re-engage the applicant within 12 months of the termination date. 11. The client shall notfiy Jam I.T. Consultancy Ltd in writing of the termination within 7 days. 12. All rebates are subject to the retention by Jam I.T. Consultancy Ltd of its service charge of £299.00. 13. The fee has been payed in full in accordance in clause 8. 14. The law of england will govern the interpretation & performace of these terms & conditions.
